This is what you agree to when you use WorkEstimado. It is written to be understood on one read. If anything is unclear, write to us before you accept.

01 Quién presta este servicio Who provides this service

WorkEstimado lo ofrece Yosiel García, como persona física, desde Florida, Estados Unidos. Cuando aquí se dice «nosotros» o «WorkEstimado», es él. WorkEstimado is offered by Yosiel García, as an individual, from Florida, United States. Where this document says “we” or “WorkEstimado,” that is him.

02 Qué es WorkEstimado, y qué no es What WorkEstimado is, and what it is not

Es un programa para hacer estimados y recibirlos firmados. Tú escribes el estimado, se lo mandas a tu cliente, él lo abre y lo firma en la pantalla de su teléfono, y a ti te llega firmado con la fecha, la hora y desde dónde. It is software for writing estimates and getting them signed. You write the estimate, send it to your client, they open it and sign on their phone screen, and it comes back to you signed, with the date, the time and where from.

Lo más importante de todo este documento The most important thing in this whole document No somos parte del acuerdo entre tú y tu cliente. El estimado es tuyo, el trabajo es tuyo y el trato es tuyo. Nosotros ponemos la herramienta con la que lo escribes y lo firmas — nada más. En concreto: no garantizamos que tu cliente te pague, no mediamos si hay un desacuerdo, no respondemos por el trabajo que hagas, y no somos tus abogados. We are not a party to the agreement between you and your client. The estimate is yours, the work is yours and the deal is yours. We provide the tool you write it and sign it with — nothing else. Specifically: we do not guarantee your client will pay you, we do not mediate disputes, we are not responsible for the work you do, and we are not your lawyers.

Sobre las firmas: en Estados Unidos una firma electrónica tiene validez legal (leyes ESIGN y UETA), y por eso guardamos el rastro completo de cada una — cuándo se mandó, cuándo se abrió, cuándo se firmó, desde qué dirección de internet. Ahora bien: que la firma sea válida no quiere decir que el documento diga lo que a ti te conviene. Lo que escribes en el estimado y en tus términos es responsabilidad tuya. About signatures: in the United States an electronic signature is legally valid (the ESIGN and UETA laws), which is why we keep the full trail of each one — when it was sent, when it was opened, when it was signed, from what internet address. That said: a valid signature does not mean the document says what you need it to say. What you write in the estimate and in your terms is your responsibility.

Y algo que no hacemos: no comprobamos tu licencia, tu seguro ni tus permisos. Que puedas hacer estimados aquí no dice nada sobre si puedes hacer ese trabajo legalmente donde vives. Eso es responsabilidad tuya. And something we do not do: we do not verify your license, your insurance or your permits. Being able to write estimates here says nothing about whether you may legally do that work where you live. That is on you.

03 Tu cuenta Your account

Tienes que ser mayor de edad y usar datos verdaderos: el nombre real de tu negocio, tu correo, tu licencia si la pones. You must be of legal age and use real information: your business's real name, your email, your license if you enter one.
Tu contraseña es tuya. Lo que se haga desde tu cuenta cuenta como hecho por ti. Si crees que alguien más entró, avísanos y cámbiala. Your password is yours. Anything done from your account counts as done by you. If you think someone else got in, tell us and change it.
Una cuenta por negocio. No la compartas ni la revendas. One account per business. Do not share it or resell it.

La prueba de 7 díasThe 7-day trial

Al crear la cuenta tienes 7 días completos con todo abierto, sin dejar ninguna tarjeta. Durante esa semana puedes hacer lo mismo que en el plan Básico. When you create your account you get 7 full days with everything open, without leaving any card. During that week you can do the same as on the Basic plan.

La tarjeta se pide al terminar la prueba, no al empezarla. Te avisamos por correo cuando quedan 3 días y otra vez el último día, con la fecha y el precio. The card is asked for when the trial ends, not when it starts. We email you when 3 days are left and again on the last day, with the date and the price.

Qué pasa el día 8 si no dejas tarjeta What happens on day 8 if you do not add a card La cuenta se pausa. Puedes entrar y mirar todo lo tuyo, pero no crear ni cambiar nada. No se borra nada, y vuelve entero el día que dejes una tarjeta.

Hay una consecuencia que conviene saber antes: mientras la cuenta esté en pausa, los enlaces de firma que ya mandaste dejan de abrirse para tus clientes. Vuelven a funcionar, los mismos, en cuanto reactives la cuenta. The account is paused. You can sign in and look at everything of yours, but not create or change anything. Nothing is deleted, and it all comes back the day you add a card.

There is one consequence worth knowing in advance: while the account is paused, the signing links you already sent stop opening for your clients. They start working again, the same ones, as soon as you reactivate the account.

Cómo se cobraHow billing works

Los planes de pago se cobran por adelantado, cada mes, a la tarjeta que dejes guardada. Los pagos los procesa la plataforma Stripe: el número de tu tarjeta no pasa por WorkEstimado ni se guarda aquí. Nosotros solo vemos la marca y los cuatro últimos dígitos, que es lo que sale en cualquier recibo. Paid plans are charged monthly, in advance, to the card you save. Payments are processed by the Stripe platform: your card number never passes through WorkEstimado and is not stored here. We only see the brand and the last four digits, which is what is printed on any receipt.

Si un cobro falla, se reintenta un par de veces. Si sigue fallando, la cuenta se pausa: no puedes crear estimados nuevos hasta arreglar la tarjeta. Pausar no borra nada — tus estimados y tus clientes siguen ahí, esperándote, y los enlaces de firma que ya mandaste vuelven a funcionar en cuanto la cuenta vuelva. If a charge fails, it is retried a couple of times. If it keeps failing, the account is paused: you cannot create new estimates until the card is fixed. Pausing deletes nothing — your estimates and clients are still there, waiting, and the signing links you already sent start working again as soon as the account is back.

CancelarCancelling

We do not refund the current month, but the service keeps working for you until the last day of the month you already paid for. Nothing else is charged.

Si cambian los preciosIf prices change

Podemos cambiar los precios, pero te avisamos por correo con 30 días y el precio nuevo solo se aplica al mes siguiente. Si no estás de acuerdo con el precio nuevo, puedes cancelar antes de esa fecha y no se te aplicará. We may change prices, but we will tell you by email 30 days ahead and the new price only applies from the following month. If you do not agree with the new price, you may cancel before that date and it will not apply to you.

05 De quién son los datos Who owns the data

Tuyos. Tus estimados, tus clientes, tus precios y las firmas que recibes son tuyos. Nosotros los guardamos para dártelos cuando entres, y para nada más: no los vendemos, no los usamos para publicidad y no se los enseñamos a nadie. Yours. Your estimates, your clients, your prices and the signatures you receive are yours. We store them so we can hand them back when you sign in, and for nothing else: we do not sell them, we do not use them for advertising and we do not show them to anyone.

Y algo concreto, que se puede comprobar: el panel con el que administramos la plataforma no puede leer los estimados de nadie. No es una promesa — es que la base de datos se niega. Desde ahí solo se ven números: cuántos estimados llevas este mes, cuántos clientes tienes, cómo va tu cobro. And something concrete, that can be verified: the panel we administer the platform from cannot read anyone's estimates. That is not a promise — the database refuses. From there we only see numbers: how many estimates you have this month, how many clients, how your billing is doing.

Hay una excepción que conviene que sepas: cuando usas el asistente, el texto de las partidas de ese estimado y los precios de tu catálogo se mandan a OpenAI para que pueda contestarte — nunca el nombre ni la dirección de tu cliente. Solo cuando lo usas, y está explicado entero en el apartado 06 de la política de privacidad. There is one exception worth knowing: when you use the assistant, the text of that estimate's line items and your catalog prices are sent to OpenAI so it can answer you — never your client's name or address. Only when you use it, and it is explained in full in section 06 of the privacy policy.

06 Lo que no se puede hacer aquí What you may not do here

Nada ilegal, ni usar la herramienta para engañar a nadie. Anything illegal, or using the tool to deceive anyone.
Hacerte pasar por otro negocio o por otra persona. Impersonating another business or another person.
Mandar correos masivos o publicidad a gente que no te los pidió. Los correos de aquí son para mandarle un estimado a un cliente tuyo. Sending bulk email or advertising to people who did not ask for it. The emails here are for sending an estimate to a client of yours.
Intentar entrar a los datos de otro negocio, o buscarle las vueltas a los límites de tu plan. Trying to reach another business's data, or working around your plan's limits.
Revender el acceso o dejárselo a terceros. Reselling access or handing it to third parties.

07 Cuándo podemos cerrar una cuenta When we can close an account

Por dejar de pagar, la cuenta se pausa — no se cierra ni se borra nada. Por usarla para algo del apartado anterior, sí podemos cerrarla. En ese caso te avisamos por correo y tienes 30 días para pedirnos una copia de todo lo tuyo antes de que se borre. For non-payment, the account is paused — it is not closed and nothing is deleted. For using it for something in the section above, we may close it. In that case we tell you by email and you have 30 days to ask us for a copy of everything of yours before it is deleted.

La única excepción a ese aviso es algo grave y obvio — un fraude en marcha, o una orden de un juez. The only exception to that notice is something serious and obvious — fraud in progress, or a court order.

08 Cuando dejes de ser cliente When you stop being a customer

Tus datos se guardan 30 días desde que la cuenta se cierra o se cancela. En ese plazo puedes pedirnos una copia o volver, y está todo. Pasados los 30 días se borran, y eso no se deshace. Your data is kept for 30 days after the account is closed or cancelled. Within that window you can ask us for a copy or come back, and everything is there. After 30 days it is deleted, and that cannot be undone.

Si tienes estimados firmados que te importan —los que sirven de prueba si un día hay un desacuerdo con un cliente— descárgalos o imprímelos antes de irte. If you have signed estimates that matter to you — the ones that serve as proof if you ever have a dispute with a client — download or print them before you leave.

09 El servicio puede fallar The service can fail

Ponemos lo que hay que poner para que esto funcione siempre, pero no prometemos que no se caiga nunca. Hay partes que no dependen de nosotros: la base de datos, el envío de correos, los pagos y el propio internet. Un día alguno de esos falla. We do what needs doing to keep this working, but we do not promise it will never go down. Parts of it are not ours: the database, email delivery, payments and the internet itself. Some day one of those fails.

Hacemos copias de seguridad periódicas y las probamos restaurándolas. Aun así, lo que de verdad no puedes perder —un estimado firmado importante— conserva también tu propia copia. Es el consejo que te daríamos con cualquier programa, incluido el nuestro. We take regular backups and we test them by restoring them. Even so, whatever you truly cannot lose — an important signed estimate — keep your own copy as well. That is the advice we would give you about any software, ours included.

Y el asistente se equivoca. Lo que escribe es un borrador para que tú lo revises: puede redactar de más, olvidar una partida o entender mal una foto. Una foto no trae medidas, y un precio que no salga de tu catálogo o de lo que tú ya has cobrado no es un precio — es una suposición. Revisa el estimado antes de mandarlo. El que firma tu cliente es tuyo y el responsable de lo que dice eres tú. And the assistant gets things wrong. What it writes is a draft for you to review: it may over-write, miss a line, or misread a photo. A photo carries no measurements, and a price that does not come from your catalog or from what you have already charged is not a price — it is a guess. Review the estimate before you send it. The one your client signs is yours, and you are answerable for what it says.

10 Hasta dónde respondemos How far our responsibility goes

El servicio se ofrece «tal como está». En la medida que la ley lo permita, nuestra responsabilidad total no pasa de lo que nos hayas pagado en los últimos doce meses. Y no respondemos de daños indirectos: trabajos que no cerraste, clientes que no te pagaron, tiempo perdido o ganancias que esperabas. The service is provided “as is.” To the extent the law allows, our total liability does not exceed what you have paid us in the last twelve months. And we are not liable for indirect damages: jobs you did not close, clients who did not pay you, time lost or profits you expected.

Esto es lo normal en este tipo de servicios, y es lo que hace posible que cueste treinta dólares al mes en vez de trescientos. This is standard for this kind of service, and it is what makes thirty dollars a month possible instead of three hundred.

11 Si estos términos cambian If these terms change

Te avisamos por correo con 30 días antes de que se aplique nada nuevo, y la fecha de arriba cambia. Si no estás de acuerdo, cancela antes de esa fecha y no te afecta. Seguir usando el servicio después es aceptarlos. We will email you 30 days before anything new applies, and the date at the top changes. If you disagree, cancel before that date and it does not affect you. Continuing to use the service after that is accepting them.

12 Qué ley se aplica Governing law

Las leyes del estado de Florida, Estados Unidos, sin tener en cuenta sus reglas de conflicto de leyes. Cualquier pleito se ve en los tribunales de Florida. The laws of the State of Florida, United States, without regard to its conflict-of-law rules. Any dispute is heard in the courts of Florida.

Si un juez decide que alguna parte de estos términos no vale, el resto sigue valiendo. If a court decides some part of these terms is unenforceable, the rest remains in force.
